Please read these Terms of Service ("Terms") carefully. These Terms govern your access to and use of the automated Pokémon trading service provided by Miraidon Sysbots ("We," "Us," or "Our"), the operators of Miraidon Sysbots. By accessing or using the Service, you agree to be bound by these Terms.
Governing Law: Nova Scotia, Canada
Miraidon Sysbots provides an automated service designed to facilitate in-game Pokémon trades. We utilize a Global Queue which our three (3) Nintendo Switch clients each draw from to process trade requests as quickly as possible.
1.1. Trade Queue Limit and Cooldown
Cooldown: Users may only trade once per minute. Once your trade is completed, you must wait sixty (60) seconds before submitting a new trade request.
Queue Limit: Users may only occupy one position in the Global Queue at any given time; you will not be able to submit a new request until your current trade is either completed or officially canceled.
1.2. Nature of Virtual Items and Risk
Legality Guarantee: All Pokémon provided by the Service are 100% legal, have passed our internal legality checks, and can, for the most part, be used online. We run a comprehensive legality check on all Pokémon requested.
Trainer Customization: We automatically apply your Original Trainer (OT) name and Secret ID (SID) to the requested Pokémon. This data is pulled directly from your Nintendo Network ID (NNID), which is provided automatically when the trade is initiated. (Some restrictions apply, which the bot will notify you of).
Pokémon HOME Disclaimer: Some Pokémon may not be able to enter Pokémon HOME due to the lack of a Home tracker. The bot will notify you if a Pokémon lacks a Home tracker.
Risk Acknowledgment: You acknowledge that using automated software to facilitate trades carries an inherently minuscule risk that may result in action taken against your Nintendo or game account by third-party platform owners (such as Nintendo or The Pokémon Company). You agree that We are not responsible if your Nintendo account or in-game profile is banned, suspended, or otherwise restricted due to your use of this Service, regardless of the cause.
2.1. System Reliability. We do not guarantee 100% uptime but do strive to keep Our systems online 24/7. Due to Our team members working external jobs, system crashes or bot downtime may take some time to resolve and return online. 2.2. Third-Party Game Data. The Service is reliant upon the continued operation of third-party game servers (Nintendo and The Pokémon Company). We are not responsible for any interruptions, changes, or termination of the Service caused by actions taken by those third parties. 2.3. Third-Party Software Dependencies. The Service utilizes proprietary software created by the developers of genpkm.com, which Our bot infrastructure runs off of.
You agree to use the Service in accordance with these Terms. Prohibited conduct includes, but is not limited to:
Attempting to use the Service for illegal, fraudulent, or malicious purposes.
Attempting to bypass or interfere with the Service's operational controls (e.g., the cooldown, queue limit, or the "leddy filter" used to prevent spam in Pokémon customization).
Abusing, harassing, or threatening the operators or other users of the Service.
Providing false or misleading information to Us.
The Service is provided primarily for free. However, we offer optional paid features to server owners:
Funding Transparency: Funds generated from the purchase of the Favored Membership are used transparently to support the Service. Funds are used to purchase new V1 Nintendo Switch consoles to support Our ever-growing community and to repair and maintain Our current fleet if needed.
4.1. Favored Membership. Server owners may purchase a Favored Membership via Ko-fi. This membership is tied to a specific Discord Server Role ID, which the Server Owner must provide to Us. When assigned to a user, this role grants the member system-wide priority access (attached to all current and future bots) within the Global Queue when trading through that specific server that holds the membership. Priority access only applies when the Global Queue reaches thirteen (13) or more users. Priority is managed by a weight system that adds increasing weight to favored members as the queue length grows; therefore, the Favored Membership does not guarantee queue jumping. The Server Owner is responsible for notifying Us immediately if they update or delete the Role ID. System updates to reflect new or changed roles may take up to twenty-four (24) hours to take effect.
4.2. Payment Terms and No Refunds. Payments are processed by Ko-fi. All purchases of the Favored Membership grant access to a digital service and are considered final and non-refundable. Access to the priority feature may be revoked if the membership is not kept up to date.
5.1. Your Right to Terminate. You may stop using the Service at any time.
5.2. Right to Terminate by Us. We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice. Repeated trade abuse will result in your account being banned from accessing the Service and may potentially also include blacklisting the entire Server.
5.3. Dispute Authority and Appeals. We are the sole decision maker when it comes to disputes or punishments related to the use of the Service. We offer the ability to appeal any punishment We may take against you, but Our ruling is final and there is to be no lawsuits or arbitration. This clause does not grant you recourse against third-party platform owners: We are not responsible if your Nintendo account gets banned.
6.1. Disclaimer of Warranties. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE 100% UPTIME.
6.2. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
7.1. Entire Agreement. These Terms constitute the entire agreement between you and Us concerning the Service.
